Welcome to Sundae Stock Archive, operated by Sundae Mood Agency AB (“Sundae Stock”, “we”, “our”, or “us”). By purchasing a membership, accessing the platform, downloading assets, or using any content available through Sundae Stock Archive, you agree to the following Terms & Conditions and Licensing Agreement.

If you do not agree to these terms, you may not access or use the platform.

1. Overview

Sundae Stock Archive is a subscription-based digital membership platform offering commercially licensed AI-generated and AI-assisted creative assets.

All content available through the platform is created fully or partially using artificial intelligence tools, workflows, and digital creative technologies.

Assets may include, but are not limited to:

  • AI-generated imagery

  • AI-assisted photography

  • Music and audio

  • Video content

  • Motion graphics

  • Templates

  • Mockups

  • Design assets

  • Campaign materials

  • Social media content

  • Graphics

  • Textures

  • Creative prompts

  • Visual collections

  • Digital downloads

  • Educational resources

  • Brand assets

  • Future digital content formats and downloadable materials

All assets remain the intellectual property of Sundae Mood Agency AB unless otherwise stated.

2. Membership Plans

Sundae Stock Archive currently offers the following membership tiers:

Founder

For single brands, founders, and small businesses.

Permitted for:

  • One registered business or brand

  • Internal commercial use

  • Social media

  • Websites

  • Email marketing

  • Organic and paid marketing

Not permitted for:

  • Client work

  • Multi-brand usage

  • Agency usage

  • Redistribution of assets

  • Resale-based commercial use

Studio

For agencies, freelancers, creatives, and multi-brand commercial work.

Permitted for:

  • Client projects

  • Agency work

  • Multi-brand usage

  • Commercial campaigns

  • Paid advertising

  • Multiple active projects while subscribed

Enterprise

For larger businesses, teams, scaling brands, subscription businesses, and high-volume commercial usage.

Includes:

  • Extended commercial licensing

  • Team and company-wide usage

  • Higher-volume usage permissions

  • Product resale and merchandising rights (where approved)

  • Custom licensing support

  • Large-scale advertising usage

  • Internal company-wide creative usage

Sundae Mood Agency AB reserves the right to determine whether a use case exceeds reasonable commercial use under lower-tier plans.

3. Subscription Terms

Memberships are available on recurring billing cycles, including:

  • Monthly

  • 3-Month

  • 6-Month

  • Yearly

Subscriptions automatically renew unless cancelled before the renewal date.

By subscribing, you authorize recurring payments through our payment processors, including Stripe and Squarespace Payments.

Free trials, promotional access periods, discounts, or temporary offers may be introduced at our discretion in the future.

4. Cancellation & Refund Policy

You may cancel your membership at any time.

Cancellation prevents future renewals but does not refund payments already made.

Due to the digital nature of the platform and immediate access to downloadable content:

  • All sales are final

  • No refunds will be issued

  • No partial refunds will be issued for unused subscription time

  • No refunds will be provided for failure to download or use content during an active membership period

Users retain access to their membership until the end of the active billing cycle.

5. Commercial License

All memberships include a non-exclusive, worldwide commercial license within the limitations of the subscriber’s membership tier.

“Non-exclusive” means the same assets may be licensed to multiple subscribers.

Subscribers may use downloaded assets for:

  • Social media

  • Advertising

  • Websites

  • Editorial content

  • Brand campaigns

  • Client projects (Studio & Enterprise only)

  • Monetized content

  • Podcasts

  • YouTube

  • Paid marketing

  • Email campaigns

  • Streaming platforms

  • Digital products and online campaigns (where permitted)

  • Commercial creative production

6. License Limitations After Cancellation

After a membership expires or is cancelled:

You may continue using assets already incorporated into:

  • Existing published posts

  • Existing advertisements

  • Existing websites

  • Existing campaigns

  • Existing client work completed during an active subscription period

However, you may NOT:

  • Use downloaded assets in new designs or campaigns

  • Create new content using archived downloads

  • Re-purpose assets for future projects

  • Continue active commercial production using expired membership access

Continued usage rights apply only to content already publicly published or actively running before cancellation.

7. Prohibited Uses

You may NOT:

  • Resell, redistribute, sublicense, share, transfer, or provide access to assets as standalone files

  • Upload assets to stock marketplaces or digital asset libraries

  • Claim assets as your own intellectual property

  • Register assets as trademarks or exclusive ownership

  • Share account access with unauthorized users

  • Use automated tools, bots, scraping systems, or mass-download software to archive the platform

  • Use assets in unlawful, misleading, defamatory, hateful, violent, discriminatory, exploitative, or pornographic content

  • Use assets in scams, misinformation, illegal activity, or deceptive advertising

  • Train AI systems, machine learning models, datasets, or generative tools using Sundae Stock assets

  • Mint, tokenize, or redistribute assets as NFTs or blockchain-based products

  • Repackage or resell collections, templates, prompts, downloads, or derivative asset packs

  • Use assets in ways that compete directly with Sundae Stock Archive

Violation of these terms may result in immediate membership termination without refund.

8. AI-Generated & AI-Assisted Content

All content available through Sundae Stock Archive is generated, assisted, edited, curated, enhanced, or otherwise created using artificial intelligence technologies and digital creative workflows.

By using the platform, you acknowledge and accept that:

  • Assets may be AI-generated or AI-assisted

  • Similarities to existing works, artists, songs, visuals, styles, brands, or individuals may occur coincidentally

  • Sundae Mood Agency AB does not guarantee exclusivity or uniqueness of AI-generated outputs

  • AI-generated content laws and platform policies may evolve over time

Subscribers are solely responsible for ensuring their own commercial usage complies with:

  • Local laws

  • Advertising regulations

  • Copyright laws

  • Platform policies

  • Third-party licensing rules

  • AI disclosure requirements where applicable

Sundae Mood Agency AB shall not be held liable for claims arising from subscriber usage of AI-generated content.

9. Music, Audio & Future Media Usage

Music, audio, video, motion, and future media content provided through Sundae Stock Archive may be used commercially within the scope of an active membership.

Permitted uses include:

  • Social media

  • Ads

  • Podcasts

  • YouTube

  • Streaming content

  • Commercial campaigns

  • Brand marketing

  • Client work (Studio & Enterprise only)

Subscribers may not:

  • Redistribute audio or media files as standalone products

  • Upload content to competing libraries

  • Register content through Content ID systems

  • Claim audio, music, or media files as original compositions or productions

  • Sell downloaded media independently from larger creative work

All ownership rights remain with Sundae Mood Agency AB.

10. Intellectual Property

All platform content, branding, collections, previews, downloadable assets, systems, and creative materials remain the intellectual property of Sundae Mood Agency AB.

Purchasing a membership grants a limited commercial usage license only. No ownership or copyright is transferred.

11. Platform Availability & Modifications

We reserve the right to:

  • Modify or remove collections

  • Add new content types

  • Introduce new membership tiers

  • Update pricing

  • Change licensing structures

  • Modify platform functionality

  • Add or remove features

  • Suspend or discontinue parts of the service

  • Update these Terms & Conditions at any time

We do not guarantee uninterrupted access or permanent availability of specific collections or files.

12. Abuse & Account Termination

We reserve the right to suspend or terminate memberships without refund if users:

  • Violate these terms

  • Abuse download access

  • Share accounts

  • Attempt redistribution

  • Use automated download systems

  • Engage in suspicious, harmful, or unauthorized activity

13. Limitation of Liability

All content and services are provided “as is” without warranties of any kind.

Sundae Mood Agency AB shall not be liable for:

  • Business losses

  • Revenue loss

  • Advertising performance

  • Third-party claims

  • Copyright disputes

  • Platform downtime

  • Service interruptions

  • Indirect or consequential damages

Subscribers assume full responsibility for how downloaded assets are used commercially.

14. Privacy

Basic account, billing, and membership information may be processed through third-party providers including Squarespace and Stripe.

A separate Privacy Policy may be introduced and updated in the future.

15. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of Sweden.

Any disputes arising from use of the platform shall be subject to Swedish jurisdiction.
